Eyesee NV and its affiliates (“EyeSee”, “we” or “us”) care about your privacy. This privacy policy explains what kind of personal data we collect and what we do with it so that you can make informed decisions about your personal data. This privacy policy applies to visitors of our website, to our former customers, potential customers and current customers and to job applicants. If you want to participate in one of our surveys as a respondent, a separate privacy policy applies.

Accessing or using our websites implies your express approval (via handing us your personal information, or via opt-in) of this privacy policy. This means that you consent to how EyeSee collects, uses and processes your personal data. If you do not accept this privacy policy, you are no longer allowed to use the websites of EyeSee. EyeSee may access or use your data either with your express approval, to perform the services detailed in an agreement or for any lawful basis.

EyeSee reserves the right to change, modify and update this privacy policy from time to time by posting a revised version on our website. Therefore, we recommend you regularly consult this policy, to make sure that you are aware of any changes.

1. Who collects your data?
EyeSee NV is the data controller under the applicable privacy regulations, which means it is EyeSee NV who determines the purposes and means of the processing of your personal data.

Eyesee NV, a Belgian company registered at Franklin Rooseveltlaan 349/B.71, 9000 Gent, Belgium, with VAT number BE 0501.712.704, and with offices at Lange Gasthuisstraat 29, 2000 Antwerpen, Belgium and EyeSee NV affiliates will collect and process your data.

2. What kind of personal data do we collect?

We may collect your first name, surname, the name of your company, your e-mail address, your address and your telephone number. We may also register your IP-address, the sector in which you are active, what your personal preferences are, and any other personal data you provide us with (e.g. curriculum vitae). Because we change our offerings and features from time to time, the options you have to provide us with personal data may also change. Here are some examples of situations in which you may decide to provide personal data to us

– if you enter into an agreement with us, we will collect all information we need to be able to identify you and to be able to execute the agreement;
– if you apply for a job with us, we will collect the information you provide us with during the job application process;
– if you ask us a question using a contact form or e-mail, we may collect the personal data you choose to provide us with;
– if you subscribe to our newsletter, we will keep your name and e-mail address on file.
– if you use our websites we may collect information such as browser features, information about actions related to our websites (such as usage, activity logs and click-throughs), domains, page views and device features.

3. For what purposes do we process your personal data?

We process your personal data for the purposes set out below. We will ask for your consent before using personal data for a purpose other than those that are set out in this privacy policy, when required under GDPR.

If you reach out to us using any of the forms provided on our website or by e-mail, we will of course use the information you have provided us with to get back to you regarding your question. The basis for the processing of this information will be legitimate interest.

To provide you with our services

If you enter into an agreement with us and ask us to provide certain services to you as a customer, we will evidently need some information about you or your company so that we can deliver those services to you and so that we can keep you duly informed. Personal data that we usually collect when you enter into an agreement with us includes: your first name, surname, the name of your company (if applicable), your e-mail address, your address, your telephone number and your payment or invoice information. Depending on the specific natures of the services, we may also need some additional data to be able to continue to provide you with quality service. The basis for the processing of this information will be our agreement or contract.

To improve our services and to develop new services

We are constantly developing and improving our services, such as the user experience on our website(s) and the other services we offer. In some cases, this may involve the processing of your personal data, for example if you have asked us questions about a service or if you have indicated certain user preferences. The basis for the processing of this information will be our legitimate interest or your consent, as the case may be.

To optimize our website, provide a better user experience, and analyze website visits

We may use cookies to facilitate and optimize the functioning and user experience of our websites. The use of cookies will be on the basis of legitimate purpose where it relates to essential cookies used solely to carry out or facilitate the working of our websites or even strictly necessary to be able the use our websites. All other cookie use will be on the basis of your consent. See also Chapter 10.

For promotional and marketing purposes

We may process your personal data for promotional or marketing purposes.

If you contact us through our website or via e-mail, if you gave us your business card at an event, if you currently are our customer or if you were our customer in the past, we will add you to our prospects database to inform you about offers or (new) services that may be of interest to you. The basis for the processing of this information will be your consent or our legitimate interests as a business to engage in direct marketing to be able to sell our services to other businesses to whom the services may be relevant. Because we have a legitimate interest as a business to contact companies which we think may be interested in buying our services, we may also add corporate e-mail addresses and phone numbers that we find online to our prospect database to contact you. In some instances, those e-mail addresses may contain personal information (for example: [email protected], rather than [email protected]).

If you do not wish to be contacted for commercial purposes or if you no longer want to receive our newsletters, you may always notify us thereof via [email protected]. We will always respect this! An easy way of unsubscribing to any of our e-mails is by following the unsubscribe instructions which you can find at the bottom of each e-mail.

To manage job applications and to keep a database of potential recruits

When you apply for a job with us, you will have to provide us with information such as your first name, last name, e-mail address, resume and other information that is relevant to the position. The basis for the processing of this information will be your legitimate interest, we will use the personal data collected in association with job postings to evaluate (and accept) candidate submissions.

Even if a candidate is not accepted, we may decide to keep the personal data collected in our database of potential recruits, so that we can keep you informed about our services and so that we can reach out to you should a new position open up that may be of interest to you. The basis for the processing of this information will be your consent.

To comply with legal or regulatory obligations

Sometimes we may have to hold on to certain personal data you have provided us with for a certain period of time to comply with legal or regulatory obligations. For example, accounting rules in principle oblige us to hold on to invoices for a period of 7 years, and invoices may have your name and e-mail address on them. The basis for the processing of this information will be to comply with our legal obligations.

4. How long do we hold on to your personal data?

In principle, we will only continue to process your personal data as long as this is necessary for the purpose for which your personal data were collected and in any case for no longer than 5 years, or, in the event of processing based on a consent, until your consent is withdrawn (whatever comes first). However, we may be under a legal obligation to hold on to some data for longer or we may need your personal data to continue to perform our contractual obligations towards you, in which case we may have to hold on to your personal data for as long as we legally or contractually need to.

5. What are your rights?

Right of access

You have the right to obtain access to your personal data, as well as to be informed about the purpose of the processing by EyeSee.

Right to rectification, erasure and restriction

You have the choice to share your personal data with EyeSee. You also have the right to request to EyeSee to rectify your personal data or have it erased. If you feel that your personal data have been processed incorrectly or incompletely, or if you feel that such processing was unnecessary, then you also can also ask us to edit, supplement or erase your personal data from our databases. You can also request the processing of your personal data to be restricted. When you choose not to share data, or when you request that we erase your personal data, we may be prevented from providing you with several services and access to the websites.

Right to object

You have the right to object to the processing of your personal data when you have legitimate reasons to do so. You also have the right to object to the use of your personal data for purposes of direct marketing. In such case specific reasoning will not be requested.

You may opt out of receiving email communications by using one of the following methods:

• Select the email “opt out” or “unsubscribe” link or follow the opt-out instructions included in each email communication.
• Contact us via the contact form https://eyesee-research.com/contact/. Be sure to provide your name, relevant contact information, and specific relevant information about EyeSee communications that you no longer wish to receive.

Please be aware that when you opt out of receiving certain subscription communications, it may affect the services you have chosen to receive from EyeSee where accepting the communications is a condition of receiving the services.

Right to data portability

You have the right to obtain your personal data which is processed by EyeSee in a structured, commonly used and machine-readable format and/or to transfer this data to another data controller.

Right to withdraw consent

When the processing is based on prior consent you have the right to withdraw this consent.

Right to file a complaint

We hope that won’t be the case, but if you do feel unhappy about how we handle your privacy requests, you may of course always lodge a complaint with the Belgian Data Protection Authority, which is EyeSee’s lead supervisory authority. However, we request that you first report them to us using the contact details mentioned above. In this way we can reach an amicable solution in mutual consultation.

If, after this notification, you are still not satisfied with the processing of your personal data by us, you can still file a complaint with the Belgian Data Protection Authority:

Exercising your rights

If you have any further privacy concerns or if you want to exercise your rights, you can contact us by letter (at any of the addresses listed above) or by e-mail (on [email protected]). If we ask you for additional information and/or appropriate proof of identity to verify your identity, this copy will only be used to identify you and authenticate your request. This data will then be immediately and permanently deleted.

We will do our best to answer all your queries as soon as possible and in any case within 30 days. We’re always open to feedback.

6. How do we protect your personal data?

We have adopted safety measures which are suited on both a technical and an organizational level to avoid the destruction, the loss, the forgery, the adjustment, the non-authorized access or the notification of the Personal Data by accident to a third party, as well as the non-authorized processing of these data. Nevertheless, if these events would occur and would affect your personal data, EyeSee will inform you of the breach without undue delay, including a summary description of the potential impact and a recommendation on measures to mitigate the possible adverse effects of the breach.

EyeSee shall not be liable in any way for direct or indirect damages caused by a wrongfully or improper use of the personal data by a third party.

7. Do we share your data with others?

EyeSee will not sell, rent, distribute or otherwise make your Personal Data commercially available to third parties, except as provided in this Notice, or when you have given your express prior consent. Only anonymized data – which means that you in no way can be identified – might be made available to other parties.

EyeSee may use third parties to perform and enable its services:

For intra-group transfers

We may share your personal information with other EyeSee entities (as listed in Chapter 1). For example, if you apply for a position with an EyeSee affiliate in the U.S., your CV will be forwarded to that affiliate. For such transfers EyeSee has implemented appropriate safeguards to ensure the security of your personal information in accordance with Chapter 9.

We use a trusted external processor

We may provide your personal information to other trusted businesses who help us process it. If we do so, the processor will always have to take appropriate confidentiality and security measures, and will have to treat your personal data based on our instructions only, in compliance with this privacy policy. We currently make use of the following external data processors:

• MailChimp (we use MailChimp to send you our newsletter)
• Formilla (we use Formilla to provide you with the chatbot on our website)
• Sales Force (we use Sales Force for CRM purposes)
• DropBox (we use DropBox to save certain data and documents, such as our invoices)
• Komex d.o.o (custom hosting solutions and server capacity)

Please note that we may also share certain personal information with our trusted advisors, such as our accountant or our lawyer. Evidently, we will also ensure they are under a confidentiality obligation.

We are under a legal obligation to do so or we need to defend ourselves against a claim

We may have to share your personal data with the authorities, if we are under a legal obligation to do so or if we have to comply with an enforceable government request. Those authorities may be situated outside of the European Union.

We hope that won’t happen, but if you ever lodge a claim against us, we may also need to share some of your personal information with others to be able to defend ourselves against that claim.

In case of a sale, merger or transfer

If we merge with another company or are bought by another company, that other company will get access to your personal data (but it will have to use it in accordance with this privacy policy). If we sell the brand EyeSee or transfer any of our concepts to a third party, we may also transfer the personal data that is clearly related to that brand or concept to that third party (again, that third party will then have to use it in accordance with this privacy policy).

8. To whom does this privacy policy apply?

This privacy policy applies to all of the services offered by Eyesee NV and its affiliates as listed above, through the websites www.eyesee-research.comwww.facialcoding.com or otherwise, with the exclusion of any survey services of EyeSee.

We may include links or references to other services or products on our website. Our privacy policy does not cover the data collection practices of any third parties. If you go to any referenced or linked site, you should make yourself familiar with the privacy policy of the third party who is responsible for the site.

9. Is any of your data stored outside of the European Union?

Some of the data processors we work with are based in the United States or elsewhere outside of the European Union and they may use servers based in the United States or elsewhere. We have entered into data processing agreements with our data processors and we will only allow them to process and store data in conformity with Standard Contractual Clauses approved by the European Commission. This means they will have to respect comparable data protection standards as those that apply in the European Union.

We also use servers which are based in the US and servers which are based in Serbia. Most of the data which relates to European data subjects is stored on our servers in the European Union, but some data may be stored in the US or in Serbia. If we store data of European data subjects outside of the European Union, we will respect comparable data protection standards as those that apply in the European Union. Within our group of companies, we have entered into agreements using Standard Contractual Clauses approved by the European Commission to ensure that your data will not be “worse off” when accessed, processed or stored by one of our group companies which is not based in the EU.

10. Do we use cookies or similar technologies?

a. What are cookies: Cookies are small files existing of numbers and letters which are placed on your computer when you visit a website.

On your first visit to our websites, you will be asked to accept our different types of cookies. You can change the cookie settings for our websites at any time via the hyperlink at the bottom of our websites and thus withdraw your consent.
